DMCA Policy

Gold Barren Kaufen respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) of 1998, the text of which can be found on the U.S. Copyright Office website, we will respond expeditiously to claims of copyright infringement committed using the Gold Barren Kaufen service and/or website (the "Site") if such claims are reported to our Designated Copyright Agent identified in the sample notice below.

This page outlines the procedure for filing copyright infringement notices and counter-notifications under the DMCA.

Filing a DMCA Notice of Infringement

If you are a copyright owner, or are authorized to act on behalf of one, and you believe that your copyrighted work has been copied in a way that constitutes copyright infringement, please submit a written DMCA notification to our Copyright Agent using the information provided on our contact page. Your notification must include substantially the following:

  1. Identification of the copyrighted work: A description of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by a single notification, a representative list of such works.
  2. Identification of the infringing material: A description of the exact URL or other specific location on the Gold Barren Kaufen Site where the material that you claim is infringing is located. Please provide enough information to allow us to locate the material (e.g., a URL link).
  3. Contact information of the complaining party: Your name, address, telephone number, and email address.
  4. Statement of good faith belief: A statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Statement of accuracy and penalty of perjury: A statement that the information in the notification is accurate, and under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
  6. Physical or electronic signature: A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Upon receipt of a valid DMCA notice, Gold Barren Kaufen will promptly remove or disable access to the allegedly infringing material and notify the user who posted the material that their content has been removed or disabled.

DMCA Counter-Notification Procedure

If you believe that your material has been removed or disabled by mistake or misidentification, you may file a counter-notification with our Copyright Agent. Your counter-notification must include substantially the following:

  • Identification of removed material: Identification of the specific URLs or other unique identifying information of the material that Gold Barren Kaufen has removed or to which access has been disabled, and the location at which the material appeared before it was removed or access to it was disabled.
  • Statement of good faith belief: A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  • Contact information of the subscriber: Your name, address, telephone number, and email address.
  • Consent to jurisdiction: A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside of the United States, for any judicial district in which Gold Barren Kaufen may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
  • Physical or electronic signature: Your physical or electronic signature.

Upon receipt of a valid counter-notification, Gold Barren Kaufen will provide the complaining party with a copy of the counter-notification. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notification, at Gold Barren Kaufen's sole discretion.
